These Terms and Conditions ("Agreement") set out the basis on which Trustacre Co., Ltd. ("we", "us", "our", "Trustacre") provides services to clients ("you", "User"). By engaging our services, submitting an enquiry, or using our website, you agree to be bound by these terms. Please read them before proceeding.
1. Definitions
- "Service" means any of the offerings described on this website: Document Filing Toolkit, Family Legacy Storytelling, and Family Meeting Facilitation.
- "User" / "Client" means any individual who engages with our services or submits an enquiry.
- "We / Us / Our" refers to Trustacre Co., Ltd.
- "Content" means materials produced as part of service delivery, including templates, written documents, audio recordings, and session notes.
- "Agreement" means these Terms and Conditions together with any service confirmation.
2. Acceptance of Terms
By submitting a contact form, making payment, or commencing a service engagement, you confirm that you have read, understood, and agree to these Terms. You must be at least 18 years old and have the legal capacity to enter into this Agreement. If you are engaging services on behalf of another person, you confirm you have authority to do so.
3. Service Description
Trustacre provides the following organisational support services:
- Document Filing Toolkit (฿4,300): A set of templates and an inventory format for personal record organisation, delivered digitally and in print.
- Family Legacy Storytelling (฿13,500): Guided sessions to capture personal or family history, resulting in a written and/or audio keepsake.
- Family Meeting Facilitation (฿32,500): A neutral facilitator who supports a structured, informal, non-binding family conversation about personal or estate-related plans.
Services are available to clients based in Thailand. Remote sessions may be arranged by prior agreement. All pricing is in Thai Baht (THB).
4. Service Scope and Limitations
Trustacre provides educational tools, organisational resources, informational guidance, and communication facilitation. We do not provide:
- Legal advice or legal document preparation
- Financial planning, investment, or tax advice
- Psychological or therapeutic services
- Notarial or official witness services
Nothing produced through Trustacre's services constitutes a legally binding document. Any legal instruments should be prepared by a qualified Thai lawyer or relevant professional.
5. User Responsibilities
- Provide accurate and complete information when engaging with our services
- Participate in good faith during sessions
- Notify us promptly if circumstances change that affect the service
- Not use our services for any unlawful purpose
- Not share session materials in a way that breaches the privacy of other participants
6. Intellectual Property
All templates, guides, frameworks, and methodologies created by Trustacre remain our intellectual property. Upon full payment for a service, you receive a personal, non-exclusive licence to use the materials delivered as part of that service for your own private family purposes. You may not reproduce, distribute, or commercialise Trustacre materials without our prior written consent.
Keepsake documents created from your family's stories and the session summary notes produced for your family meeting are considered your content. You own those.
7. Payment Terms
- Payment is due in full prior to the commencement of services, unless otherwise agreed in writing
- Payments accepted by bank transfer, PromptPay, or agreed digital payment method
- All prices are quoted and payable in Thai Baht (THB)
- An invoice is available on request
Cancellation and Refunds
- Cancellations made more than 5 business days before a scheduled session: full refund
- Cancellations made 2–5 business days before a session: 50% refund
- Cancellations made within 48 hours of a session: no refund, unless due to illness or emergency notified in advance
- Digital toolkit purchases (Document Filing Toolkit): no refund once materials have been delivered
8. Confidentiality
We treat all information shared during service engagements as confidential. Our facilitators and staff are bound by confidentiality obligations. We do not disclose client information to third parties except as described in our Privacy Policy or as required by law.
In the case of Family Meeting Facilitation, the facilitator does not share the content of discussions with any party outside the meeting unless all participants consent.
9. Disclaimers
Our services are provided in good faith and based on reasonable professional care. However:
- We do not guarantee any particular outcome from our services
- Family meeting facilitation is informal and non-binding — we cannot ensure that participants reach agreement
- We are not responsible for decisions made by you or your family members as a result of using our services
- Content on our website is provided for information purposes only and does not constitute professional advice
10. Limitation of Liability
To the extent permitted by Thai law, Trustacre's total liability to you in connection with any service shall not exceed the amount paid for that specific service. We are not liable for indirect, consequential, or incidental losses arising from the use of our services or website. Nothing in these terms excludes liability for fraud or death or personal injury caused by our negligence.
11. Indemnification
You agree to indemnify Trustacre against any claims, losses, or expenses arising from your breach of these Terms, your misuse of our services, or any third-party claim arising from actions you take based on our services.
12. Termination
Either party may terminate a service engagement by written notice. If we terminate a service due to your breach of these Terms, fees already paid may not be refunded. If you choose to discontinue a multi-session service after it has begun, the refund schedule in Section 7 applies. Sections 8, 9, 10, and 13 survive termination.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Kingdom of Thailand. Any disputes arising from or in connection with these Terms shall first be referred to informal resolution by mutual discussion. Where informal resolution is not possible, disputes shall be subject to the jurisdiction of the Thai courts.
14. General Provisions
- Entire agreement: These Terms, together with any service confirmation, constitute the entire agreement between us.
- Severability: If any provision is found to be unenforceable, the remaining provisions remain in force.
- Waiver: Failure to enforce a term does not constitute a waiver of that term.
- Assignment: You may not assign your rights under this Agreement without our consent.
15. Changes to These Terms
We may update these Terms from time to time. Updated terms will be published on this page with a revised date. Continued use of our services after the effective date of any update constitutes acceptance of the revised terms. For material changes, we will notify active clients by email where possible.
